Что нужно знать про договор ипотеки?

Оформляя заем на жилье, должнику никак не уйти и от заключения ипотечного договора, вместе с договором кредитным. При этом, если кредитное соглашение описывает условия получения и последующей выплаты займа, то договор ипотеки очерчивает обстоятельства обременения самой недвижимости, а также обязанности и права сторон по отношению к ней. Порой, из-за незнания пунктов данного договора, заемщики неосознанно нарушают их, и это приводит к наказаниям со стороны банка. Информация о недвижимостиВвиду того, что договор ипотеки – это документ, оговаривающий все, что касается предмета залога, а именно - недвижимости, в первом его разделе ведется описание тех «квадратных метров», которые банк согласился принять в роли обеспечения. В данном пункте указывается, что из себя представляет объект – квартира это или частное домостроение, и по какому адресу он расположен. Если это квартира, то указывается этажность и внутренняя планировка. Если частный дом – дополнительно описывается земельный участок. Кроме того, договор ипотеки обязательно должен ссылаться на соглашение о займе, на основании которого жилище и стало залогом. Здесь же указывается сумма займа, наименование кредитной организации, а также срок, до которого долг нужно возвратить. Эта же дата станет сроком окончания действия и ипотечного договора, потому как только полное погашение кредита послужит основанием для снятия с недвижимости обременения. Об оценке и страховкеПеред тем как выдать ипотечный заем, банк всегда инициирует оценку недвижимости, чтобы определиться с ее ликвидностью. Информация, полученная от оценщиков, также включается в ипотечное соглашение. Если ипотека выдается на еще недостроенный дом, то компанией-оценщиком берутся во внимание и те материалы, которые только планируется использовать при дальнейшем возведении. Согласно закону любая недвижимость, покупаемая в России, должна быть застрахована от разрушений и катаклизмов. Впрочем, если при покупке жилья за свои деньги человек может страховать имущество где ему вздумается, то при оформлении ипотеки ему наверняка придется сотрудничать только с аккредитованным в банке страховщиком. Его реквизиты, а также условия страхования непременно будут включены в договор ипотеки. При этом, в качестве получателя компенсаций по страховке выступит не заемщик, а банк - на правах залогодержателя. Договор ипотеки – кто, на что имеет право? Пожалуй, важнейшим местом договора об ипотеке будут пункты о правах и обязанностях сторон. Именно их незнание зачастую и приводит заемщиков к конфликтам с банками. Кстати у самих финансовых организаций обязанностей по данному договору не так и много. Во-первых, они обязаны выдать заемщику закладную и справку о выплате долга, как только ипотечный заем будет погашен до конца. Во-вторых, им нужно информировать заемщика о передаче права на закладную иным организациям или лицам, если таковое произойдет. Основное право заемщика – это использовать недвижимость по ее непосредственному назначению, то есть для собственного проживания. В ответ же должник обязуется, к примеру, не продавать жилплощадь без предварительного разрешения банка, не дарить ее и не сдавать в наем. Кроме того, заемщику нужно следить за состоянием жилья, проводить его плановый ремонт, а также регулярно платить страховку и коммунальные выплаты. Более того, по требованию банка (примерно раз в год) заемщик обязан предоставлять квитанции как о коммунальных платежах, так и о продлении полиса. К тому же не исключены и личные визиты представителей банка домой к должнику, чтобы проверить состояние залоговой недвижимости. Нарушение этих обязанностей может привести к штрафам и даже к досрочному затребованию возврата долга.

The War on Drugs is a campaign of prohibition and foreign military aid and military intervention being undertaken by the United States government, with the assistance of participating countries, intended to both define and reduce the illegal drug trade. The term "War on Drugs" was first used by President Richard Nixon in 1971. On May 13, 2009, Gil Kerlikowske, the current Director of the Office of National Drug Control Policy (ONDCP), signaled that although it did not plan to significantly alter drug enforcement policy, the Obama administration would not use the term "War on Drugs," as he claims it is "counter-productive". ONDCP's view is that "drug addiction is a disease that can be successfully prevented and treated... making drugs more available will make it harder to keep our communities healthy and safe."(2011) One of the alternatives that Mr Kerlikowske has showcased is Sweden's Drug Control Policies that combine balanced public health approach and opposition to drug legalization. The prevalence rates for cocaine use in Sweden are barely one-fifth of European neighbors such as the United Kingdom and Spain. In June 2011, the Global Commission on Drug Policy released a critical report on the War on Drugs, declaring "The global war on drugs has failed, with devastating consequences for individuals and societies around the world. Fifty years after the initiation of the UN Single Convention on Narcotic Drugs, and years after President Nixon launched the US government's war on drugs, fundamental reforms in national and global drug control policies are urgently needed." The report was immediately criticized by organizations that oppose a general legalization of drugs. In 1986, the US Defense Department funded a two-year study by the RAND Corporation, which found that the use of the armed forces to interdict drugs coming into the United States would have little or no effect on cocaine traffic and might, in fact, raise the profits of cocaine cartels and manufacturers. The 175-page study, "Sealing the Borders: The Effects of Increased Military Participation in Drug Interdiction," was prepared by seven researchers, mathematicians and economists at the National Defense Research Institute, a branch of the RAND, and was released in 1988. The study noted that seven prior studies in the past nine years, including one by the Center for Naval Research and the Office of Technology Assessment, had come to similar conclusions. Interdiction efforts, using current armed forces resources, would have almost no effect on cocaine importation into the United States, the report concluded. During the early-to-mid-1990s, the Clinton administration ordered and funded a major cocaine policy study, again by RAND. The Rand Drug Policy Research Center study concluded that $3 billion should be switched from federal and local law enforcement to treatment. The report said that treatment is the cheapest way to cut drug use, stating that drug treatment is twenty-three times more effective than the supply-side "war on drugs". The National Research Council Committee on Data and Research for Policy on Illegal Drugs published its findings on the efficacy of the drug war. The NRC Committee found that existing studies on efforts to address drug usage and smuggling, from U.S. military operations to eradicate coca fields in Colombia, to domestic drug treatment centers, have all been inconclusive, if the programs have been evaluated at all: "The existing drug-use monitoring systems are strikingly inadequate to support the full range of policy decisions that the nation must make.... It is unconscionable for this country to continue to carry out a public policy of this magnitude and cost without any way of knowing whether and to what extent it is having the desired effect." The study, though not ignored by the press, was ignored by top-level policymakers, leading Committee Chair Charles Manski to conclude, as one observer notes, that "the drug war has no interest in its own results." During alcohol prohibition, the period from 1920 to 1933, alcohol use initially fell but began to increase as early as 1922. It has been extrapolated that even if prohibition had not been repealed in 1933, alcohol consumption would have quickly surpassed pre-prohibition levels. A crime of passion, or crime passionnel, in popular usage, refers to a violent crime, especially murder, in which the perpetrator commits the act against someone because of sudden strong impulse such as sudden rage or heartbreak rather than as a premeditated crime. The act, as is suggested by the name (crime passionnel - from French language) is often associated with the history of France. However, such crimes have existed and continue to exist in most cultures. A crime of passion refers to a criminal act in which the perpetrator commits a crime, especially murder or assault, against someone because of sudden strong impulse such as sudden rage or heartbreak rather than as a premeditated crime. A typical crime of passion might involve an aggressive pub-goer who assaults another guest following an argument or a husband who discovers his wife has made him a cuckold and proceeds to brutally batter or even kill his wife and the man with whom she was involved. In the United States civil courts, a crime of passion is referred to as "temporary insanity". This defense was first used by U.S. Congressman Daniel Sickles of New York in 1859 after he had killed his wife's lover, Philip Barton Key, but was most used during the 1940s and 1950s. Together with the Authorized version and the works of Shakespeare, the Book of Common Prayer has been one of the three fundamental underpinnings of modern English. As it has been in regular use for centuries, many phrases from its services have passed into the English language, either as deliberate quotations or as unconscious borrowings. They are used in non-liturgical ways. For example, many authors have used quotes from the prayer book as titles for their books. Some examples of well-known phrases from the Book of Common Prayer are: "Speak now or forever hold your peace" from the marriage liturgy. "Till death us do part", from the marriage liturgy. "Earth to earth, ashes to ashes, dust to dust" from the funeral service. "From all the deceits of the world, the flesh, and the devil" from the litany. "Read, mark, learn, and inwardly digest" from the collect for the second Sunday of Advent. "Evil liver" from the rubrics for Holy Communion. "All sorts and conditions of men" from the Order for Morning Prayer. "Peace in our time" from Morning Prayer, Versicles. The phrase "till death us do part" ("till death us depart" before 1662[5]) has been changed to "till death do us part" in some more recent prayer books, such as the 1962 Canadian Book of Common Prayer. References and allusions to Prayer Book services in the works of Shakespeare were tracked down and identified by Richmond Noble (Noble 1935, p. 82). Derision of the Prayer Book or its contents "in any interludes, plays, songs, rhymes, or by other open words" was a criminal offence under the 1559 Act of Uniformity,[6] and consequently Shakespeare avoids too direct reference; but Noble particularly identifies the reading of the Psalter according to the Great Bible version specified in the Prayer Book, as the biblical book generating the largest number of Biblical references in Shakespeare's plays. Noble found a total of 157 allusions to the Psalms in the plays of the First Folio, relating to 62 separate Psalms—all, save one, of which he linked to the version in the Psalter, rather than those in the Geneva Bible or Bishops' Bible. In addition, there are a small number of direct allusions to liturgical texts in the Prayer Book; e.g. Henry VIII 3:2 where Wolsey states "Vain Pomp and Glory of this World, I hate ye!", a clear reference to the rite of Public Baptism; where the Godparents are asked "Doest thou forsake the vaine pompe and glory of the worlde..?" More recently, P.D. Julius Henry "Groucho" Marx (October 2, 1890 -- August 19, 1977) was an American comedian and film and television star. He is known as a master of quick wit and widely considered one of the best comedians of the modern era. His rapid-fire, often impromptu delivery of innuendo-laden patter earned him many admirers and imitators. He made 13 feature films with his siblings the Marx Brothers, of whom he was the third-born. He also had a successful solo career, most notably as the host of the radio and television game show You Bet Your Life. His distinctive appearance, carried over from his days in vaudeville, included quirks such as an exaggerated stooped posture, glasses, cigar, and a thick greasepaint mustache and eyebrows. These exaggerated features resulted in the creation of one of the world's most ubiquitous and recognizable novelty disguises, known as "Groucho glasses", a one-piece mask consisting of horn-rimmed glasses, large plastic nose, bushy eyebrows and mustache. Groucho Marx was, and is, the most recognizable and well-known of the Marx Brothers. Groucho-like characters and references have appeared in popular culture both during and after his life, some aimed at audiences who may never have seen a Marx Brothers movie. Groucho's trademark eye glasses, nose, mustache, and cigar have become icons of comedy—glasses with fake noses and mustaches (referred to as "Groucho glasses", "nose-glasses," and other names) are sold by novelty and costume shops around the world. Nat Perrin, close friend of Groucho Marx and writer of several Marx Brothers films, inspired John Astin's portrayal of Gomez Addams on the 1960s TV series The Addams Family with similarly thick mustache, eyebrows, sardonic remarks, backward logic, and ever-present cigar (pulled from his breast pocket already lit). Alan Alda often vamped in the manner of Groucho on M*A*S*H. In one episode, "Yankee Doodle Doctor", Hawkeye and Trapper put on a Marx Brothers act at the 4077, with Hawkeye playing Groucho and Trapper playing Harpo. In three other episodes, a character appeared who was named Captain Calvin Spalding (played by Loudon Wainwright III). Groucho's character in Animal Crackers was Captain Geoffrey T. Spaulding. On many occasions, on the 1970s television sitcom All In The Family, Michael Stivic (Rob Reiner), would briefly imitate Groucho Marx and his mannerisms. Two albums by British rock band Queen, A Night at the Opera (1975) and A Day at the Races (1976), are named after Marx Brothers films. In March 1977, Groucho invited Queen to visit him in his Los Angeles home; there they performed "'39" a capella. A long-running ad campaign for Vlasic Pickles features an animated stork that imitates Groucho's mannerisms and voice. On the famous Hollywood Sign in California, one of the "O"s is dedicated to Groucho. Alice Cooper contributed over $27,000 to remodel the sign, in memory of his friend. In 1982, Gabe Kaplan portrayed Marx in the film Groucho, in a one-man stage production. He also imitated Marx occasionally on his previous TV sitcom Welcome Back, Kotter. Actor Frank Ferrante has performed as Groucho Marx on stage for more than two decades. He continues to tour under rights granted by the Marx family in a one-man show entitled An Evening With Groucho in theaters throughout the United States and Canada with piano accompanist Jim Furmston. In the late 1980s Ferrante starred as Groucho in the off-Broadway and London show Groucho: A Life in Revue penned by Groucho's son Arthur. Ferrante portrayed the comedian from age 15 to 85. The show was later filmed for PBS in 2001. Woody Allen's 1996 musical Everyone Says I Love You, in addition to being named for one of Groucho's signature songs, ends with a Groucho-themed New Year's Eve party in Paris, which some of the stars, including Allen and Goldie Hawn, attend in full Groucho costume. The highlight of the scene is an ensemble song-and-dance performance of "Hooray for Captain Spaulding"—done entirely in French. In the last of the Tintin comics, Tintin and the Picaros, a balloon shaped like the face of Groucho could be seen in the Annual Carnival. In the Italian horror comic Dylan Dog, the protagonist's sidekick is a Groucho impersonator whose character became his permanent personality. The BBC remade the radio sitcom Flywheel, Shyster and Flywheel, with contemporary actors playing the parts of the original cast. The series was repeated on digital radio station BBC7. Scottish playwright Louise Oliver wrote a play named Waiting For Groucho about Chico and Harpo waiting for Groucho to turn up for the filming of their last project together. This was performed by Glasgow theatre company Rhymes with Purple Productions at the Edinburgh Fringe and in Glasgow and Hamilton in 2007-08. Ancient epic poems such as the Epic of Gilgamesh, Homer's Odyssey and the Mahābhārata use similar narrative techniques as modern thrillers. In the Odyssey, the hero Odysseus makes a perilous voyage home after the Trojan War, battling extraordinary hardships in order to be reunited with his wife Penelope. He has to contend with villains such as the Cyclops, a one-eyed giant, and the Sirens, whose sweet singing lures sailors to their doom. In most cases, Odysseus uses cunning instead of brute force to overcome his adversaries. Little Red Riding Hood (1697), an early example of a psycho-stalker story, is a fairy tale about a girl who walks through the woods to deliver food to her sick grandmother. A wolf wants to eat the girl but is afraid to do so in public. He approaches Little Red Riding Hood and she naively tells him where she is going. He suggests the girl pick some flowers, which she does. In the meantime, he goes to the grandmother's house and gains entry by pretending to be the girl. Heart of Darkness (1903) is a first-person within a first-person account about a man named Marlowe who travels up the Congo River in search of an enigmatic Belgian trader named Kurtz. The Thirty-Nine Steps (1915) is an early thriller by John Buchan, in which an innocent man becomes the prime suspect in a murder case and finds himself on the run from both the police and enemy spies. The Manchurian Candidate (1959) is a classic of Cold War paranoia. A squad of American soldiers are kidnapped and brainwashed by Communists. False memories are implanted, along with a subconscious trigger that turns them into assassins at a moment's notice. They are soon reintegrated into American society as sleeper agents. The Great Gildersleeve (1941--1957), initially written by Leonard Lewis Levinson, was one of broadcast history's earliest spin-off programs. Built around Throckmorton Philharmonic Gildersleeve, a character who had been a staple on the classic radio situation comedy Fibber McGee and Molly, first introduced on Oct. 3, 1939, ep. #216. The Great Gildersleeve enjoyed its greatest success in the 1940s. Actor Harold Peary played the character during its transition from the parent show into the spin-off and later in a quartet of feature films released at the height of the show's popularity. On Fibber McGee and Molly, Peary's Gildersleeve was a pompous windbag who became a consistent McGee nemesis. "You're a haa-aa-aa-aard man, McGee!" became a Gildersleeve catchphrase. The character was given several conflicting first names on Fibber McGee and Molly, and on one episode his middle name was revealed as Philharmonic. Gildy admits as much at the end of "Gildersleeve's Diary" on the Fibber McGee and Molly series (Oct. 22, 1940). He soon became so popular that Kraft Foods—looking primarily to promote its Parkay margarine spread — sponsored a new series with Peary's Gildersleeve as the central, slightly softened and slightly befuddled focus of a lively new family. The Credit Card Accountability Responsibility and Disclosure Act of 2009 or Credit CARD Act of 2009 is a federal statute passed by the United States Congress and signed by President Barack Obama on May 22, 2009. It is comprehensive credit card reform legislation that aims "...to establish fair and transparent practices relating to the extension of credit under an open end consumer credit plan, and for other purposes." The bill was passed with bipartisan support by both the House of Representatives and the Senate. The Credit Cardholders' Bill of Rights was introduced in the 110th Congress as H.R. 5244 in the House of Representatives by Representative Carolyn Maloney, a Democrat from New York and the chair of the House Financial Services Committee's Subcommittee on Financial Institutions and Consumer Credit. The bill had passed 312 to 112 but was never given a vote in the Senate. In the 111th United States Congress the bill was reintroduced as H.R. 627 and on April 30, 2009, the House passed it, with a strong bipartisan basis, with 357 yes votes to 70 no votes. The Senate followed suit and passed an amended version on May 19 with 90 yes votes and 5 no votes. The House passed the amended bill the next day by a vote of 279 to 147 and it was signed into law by President Barack Obama on May 22, 2009. The bill went into effect on February 22, 2010, nine months after it was enacted. The Credit Cardholders' Bill of Rights includes several provisions aimed at limiting how credit card companies can charge consumers but does not include price controls, rate caps, or fee settings. Gun rights advocates in the Senate, led by Tom Coburn (R-Okla) added an unrelated rider to the bill to prevent the Secretary of the Interior from enforcing any regulation that would prohibit an individual from possessing a firearm in any unit of the National Park System or the National Wildlife Refuge System. The Senate passed the amendment 67-29. This amendment overturns a Reagan-era policy prohibiting firearms from being carried in national parks. The George W. Bush administration had attempted to implement a similar policy through the rulemaking process just before leaving office, but the change was struck down by a federal judge. The provision has been heavily criticized by environmentalists, anti-gun groups, and park supporters, including the Coalition of National Park Service Retirees, but it was applauded by gun rights groups. The act was not expected to affect existing credit card contracts. However, the act that was passed applies to contracts made in the past by setting an effective date of February 22, 2010, which gave banks time to prepare and notify their customers. While it is a common criticism that the CARD Act led banks to raise interest rates and limit credit availability in response to its passage, studies by CardHub.com and the Center for Responsible Lending revealed that such trends were merely the result of economic pressures typical of a recession and not the law. Actually, according to these studies, historical economic data shows that the interest rate increase and decline in available credit seen during the Great Recession should have been worse considering the widespread unemployment, credit card delinquency and credit card charge-offs. In a speech on the one-year anniversary of the CARD Act, Special Adviser Elizabeth Warren said that "much of the [credit card] industry has gone further than the law requires in curbing re-pricing and overlimit fees." However, she said there was still much work to be done, that the Consumer Financial Protection Bureau's "next challenges will be about further clarifying price and risks and making it easier for consumers to make direct product comparisons." In 2012, many stay-at-home mothers complained that because they have no individual income, the act prevents them from acquiring credit cards without their husbands' permission. As of September 21, 2012, the CFPB announced that they would be making the change due to a petition on Change.org.
